The most common reason § 101 challenges fail is a failure to establish the first step of the
Alice analysis, that the challenged claims are directed to an abstract idea or some other patent ineligible subject matter. However, eighteen § 101 challenges were denied for failure to show the second step, that the claims lacked an inventive concept.
