The court granted plaintiff's motion to compel the production of defendants' marketing and distribution strategy information for its ANADA products. "[Plaintiff] maintains that [defendant] has followed, what [plaintiff] believes is the general model for generic brand companies; i.e., to intrude upon and 'capture' the brand market. . . . The requested information may lead to the discovery of relevant evidence regarding whether [defendant] encourages its distributors/end-users to infringe."
